Staff Mitr – Customer Responsibilities and Acceptable Use Policy

Effective Date: 1 January 2025 • Last Updated: 3 November 2026

1. Customer Responsibility for Employee Information

The organisation registering and using Staff Mitr ("Customer") is responsible for ensuring that all employee information entered into the platform is accurate, lawful and collected with the necessary authority and permissions.

The Customer is responsible for verifying employee identity, age, employment eligibility and other legally required details.

Staff Mitr does not independently verify the age or employment eligibility of every employee registered by a Customer.

2. Child Labour and Minimum Age Compliance

Staff Mitr does not support, promote or encourage child labour or unlawful employment practices.

Customers must not use Staff Mitr to facilitate the employment or engagement of children in violation of applicable laws, including the Child and Adolescent Labour (Prohibition and Regulation) Act, 1986.

Customers are solely responsible for verifying the age and legal eligibility of every person they employ or engage and for complying with restrictions applicable to adolescents and hazardous occupations.

Staff Mitr reserves the right to investigate reported misuse and suspend or terminate access where unlawful activity is reasonably identified, in accordance with applicable law and contractual terms.

3. Employment, Salary and Labour Law Compliance

The Customer is responsible for complying with all applicable employment and labour laws, including requirements relating to:

  • Salary and wage payments.
  • Minimum wages and overtime.
  • Working hours, shifts and rest periods.
  • Employee leave and other statutory entitlements.
  • Provident Fund (PF), Employee State Insurance (ESI), where applicable, and other statutory contributions.
  • Employment records, notices and statutory reporting.
  • Lawful treatment and protection of employee information.

Staff Mitr provides software tools to help organisations manage workforce information and related processes. Unless expressly agreed otherwise, Staff Mitr does not act as the employer, payroll-paying entity, labour-law adviser or statutory compliance authority for the Customer.

The Customer remains responsible for reviewing and verifying payroll calculations, employment decisions and statutory obligations before acting on them.

4. Customer Data and Platform Access

Customers retain their applicable rights and responsibilities concerning the employee and organisation information they submit to Staff Mitr.

Staff Mitr processes customer information only as described in its Privacy Policy, applicable agreements and service requirements.

The extent to which Staff Mitr personnel can access customer information depends on the platform's actual technical architecture, security controls and authorised operational requirements. Staff Mitr does not promise that access is technically impossible unless the platform has been designed and verified to provide that protection.

Customers are responsible for ensuring that their authorised users access and use employee information only for legitimate business purposes.

5. Unlawful Use and Customer Indemnification

Customers must not use Staff Mitr to facilitate unlawful employment, wage violations, fraud, unauthorised access, misuse of employee information or any other prohibited activity.

To the extent permitted by applicable law, the Customer is responsible for claims, losses and liabilities arising from its own unlawful acts, omissions, employment decisions, inaccurate information or breach of these terms.

This provision does not exclude or limit any responsibility that Staff Mitr cannot lawfully exclude or limit, including its own applicable legal obligations.

6. Suspension and Termination

Staff Mitr reserves the right to restrict, suspend or terminate access to the platform where there is reasonable evidence of unlawful use, material misuse, security risks or violations of these Terms and Conditions, subject to applicable law.

7. Acceptance

By registering an organisation and using Staff Mitr, the Customer confirms that it has read, understood and agreed to these Customer Responsibilities and Acceptable Use Policy provisions.
